Federal lawsuit filed over Medicaid cutoffs in Nebraska [Video]

LINCOLN — Nebraska Appleseed has filed a federal class action lawsuit claiming that the state is cutting thousands of Nebraskans off Medicaid without due process.

The suit was filed in U.S. District Court on behalf of Gillian Filyaw, a 23-year-old North Platte woman, and other Nebraskans who were dropped from Medicaid after pandemic-era protections ended last year.

The suit alleges that Filyaw originally enrolled in Medicaid in October or November 2020, when she discovered she was pregnant. The Nebraska Department of Health and Human Services ended her coverage on May 1, following a review of her eligibility. The only reason provided was “income exceeds standards.” 

According to the lawsuit, she was not given any other information — such as the state’s calculation of her household income, household size or the income limit used for households of that size to qualify for Medicaid — that would be needed to adequately prepare …
