The Supreme Court ruled unanimously on Thursday to preserve access to the widely used abortion medication mifepristone. The case could’ve restricted access to mifepristone, including in states where abortion is legal, and impacted the federal drug approval process. Instead, the justices ruled that anti-abortion doctors who brought the case lacked the legal right to sue because they don’t prescribe or use the drug, and the Food and Drug Administration is not requiring them to do so. In the court’s opinion, Justice Brett Kavanaugh wrote, “Under Article III of the Constitution, a plaintiff ’s desire to make a drug less available for others does not establish standing to sue.” The case centered on the FDA’s rules for prescribing and distributing mifepristone, including steps taken to expand access, like making the medication available by mail.
