One might be if there is a disparity in the assets between the husband and the wife, they might consider a postnuptial agreement to set out what will happen in the unfortunate event of a divorce so they don’t fight in family court and let a judge decide. They can decide how their assets would be divided. Each of them should also have a durable power of attorney so the other one can handle his or her affairs when the one party cannot. Also, they obviously should have a living will and a healthcare power of attorney, and it’s really never too soon to enter into a trust or each of them should have a will if not a trust.
